1.2. Dalam Dasar Privasi ini, “Platform” merujuk kepada semua laman web dan antara muka web/mudah alih DTDS yang berkaitan, dan “Perkhidmatan” merujuk kepada semua produk, maklumat, fungsi dan perkhidmatan yang disediakan oleh DTDS dari semasa ke semasa melalui Platform tersebut.
1.3. Dasar Privasi ini menerangkan bagaimana kami mengumpul, menggunakan, mendedahkan, menyimpan dan/atau memproses data peribadi apabila kami menyediakan Perkhidmatan atau memberikan akses kepada Platform, sama ada anda telah mendaftarkan akaun dengan kami atau tidak.
1.4. Sila baca Dasar Privasi ini bersama dengan sebarang notis tambahan yang mungkin kami sediakan pada masa kami mengumpul, menggunakan, mendedahkan atau sebaliknya memproses data peribadi anda untuk aplikasi atau ciri tertentu.
1.5. Kami mungkin mengemas kini Dasar Privasi ini dari semasa ke semasa. Sebarang perubahan akan dicerminkan di halaman ini dan, jika material, dimaklumkan kepada anda melalui cara yang bersesuaian. Dasar Privasi ini beroperasi bersama dengan notis lain, terma kontraktual dan klausa persetujuan yang berkaitan dengan pengumpulan, penggunaan, pendedahan dan/atau pemprosesan data peribadi anda oleh kami dan tidak bertujuan untuk mengatasi dokumen-dokumen tersebut melainkan kami menyatakan sebaliknya secara nyata.
1.7. Melainkan dinyatakan sebaliknya, semua terma terpakai kepada semua pengguna Platform, sama ada anda telah mencipta akaun dengan kami atau tidak.

Dasar Privasi ini hanya terpakai kepada pelanggan dan wakil mereka, individu hubungan, pengguna yang diberi kuasa, penerima konsainan dan individu lain yang berada di Malaysia dan yang mengakses Platform kami, membeli produk kami atau sebaliknya berinteraksi dengan Perkhidmatan kami di Malaysia. Jika anda adalah pelanggan yang berada di luar Malaysia, sila rujuk dasar privasi kami yang khusus untuk bidang kuasa anda.
2. Data Peribadi Yang Kami Kumpulkan
2.1. Kami mengumpul data peribadi selaras dengan PDPA dan, jika diperlukan, dengan persetujuan anda.
2.2. “Data peribadi” bermaksud sebarang maklumat, data peribadi sensitif dan ungkapan pendapat mengenai seseorang individu, sama ada benar atau tidak, yang membolehkan individu tersebut dikenal pasti, sama ada daripada data itu sahaja atau bersama dengan data lain yang kami pegang atau mungkin mempunyai akses kepadanya; tetapi tidak termasuk sebarang maklumat yang tidak merupakan data peribadi di bawah PDPA.
2.3. Bergantung kepada cara anda menggunakan Platform kami dan/atau berinteraksi dengan Perkhidmatan kami, anda boleh memilih untuk memberikan kategori data peribadi berikut:
(a) Data Identiti dan Profil
Nama, jawatan, nama syarikat, jabatan
Alamat e-mel perniagaan, nombor telefon
Nama pengguna dan kata laluan
Sebarang data peribadi yang terkandung dalam gambar, video atau rakaman audio yang anda muat naik ke Platform
(b) Data Akaun dan Transaksi
Alamat pengebilan dan penghantaran
Pesanan yang dibuat dan diterima (cth. pesanan untuk komponen elektronik / semikonduktor)
Maklumat berkaitan pembayaran (cth. butiran akaun bank atau kad yang diberikan melalui penyedia perkhidmatan pembayaran)
(c) Data Penggunaan
Maklumat tentang cara dan bila anda menggunakan Platform dan Perkhidmatan, halaman yang anda lihat, dan interaksi anda dengan fungsi dan kandungan
Rujukan laman web dan statistik penggunaan lain
(d) Data Pemasaran dan Komunikasi
Keutamaan anda untuk menerima bahan pemasaran dan kemas kini teknikal
Rekod komunikasi anda dengan kami (cth. e-mel, sembang dalam talian, log panggilan, pertanyaan, tinjauan)
(e) Data Lokasi
Jika berkaitan, lokasi anggaran untuk tujuan status penghantaran, logistik atau pencegahan penipuan.
2.4. Kami juga secara automatik mengumpul dan memproses maklumat tertentu apabila anda mengakses Platform atau berinteraksi dengan Perkhidmatan kami, seperti alamat IP anda, jenis penyemak imbas, sistem pengendalian, URL rujukan, halaman yang dilayari dan masa akses. Kami mengumpul data ini untuk membantu kami menganalisis dan menambah baik laman web, produk serta Perkhidmatan kami; menyesuaikan kandungan dan susun atur; serta menyediakan pengalaman pengguna yang lebih selamat dan selesa.
Cara Kami Menerima Data Peribadi Anda
2.5. Kami mungkin menerima data peribadi daripada anda dalam pelbagai situasi termasuk apabila:
Anda melayari laman web kami (desktop atau mudah alih)
Anda mencipta akaun dengan kami
Anda membuat pesanan, meminta sebut harga, atau sebaliknya berurus niaga di Platform
Anda menggunakan fungsi berkaitan pembayaran yang ditawarkan di Platform atau oleh pembekal pihak ketiga kami
Anda menghubungi perkhidmatan pelanggan kami (sembang dalam talian, e-mel, telefon, borang hubungan)
Anda melanggan komunikasi pemasaran atau surat berita teknikal kami
Anda menyertai acara, promosi, webinar atau tinjauan yang dianjurkan oleh DTDS
Anda log masuk ke akaun anda melalui perkhidmatan luaran (cth. Google, LinkedIn)
Anda sebaliknya berinteraksi dengan kami secara luar talian (cth. melalui telefon atau mesyuarat bersemuka)
2.6. Kami juga mungkin mengumpul data peribadi daripada pihak ketiga (termasuk penyedia perkhidmatan pembayaran, rakan logistik, biro kredit, penyedia analitik, rakan perniagaan, ejen dan kontraktor) dan daripada syarikat gabungan kami, atau data tersebut mungkin dikumpulkan secara automatik apabila anda menggunakan Platform atau Perkhidmatan.
2.7. Apabila anda memberikan kepada kami data peribadi individu lain (cth. rakan sekerja atau penerima konsainan), anda menyatakan dan menjamin bahawa anda telah diberikan kuasa untuk berkongsi, memindahkan dan membenarkan kami memproses data peribadi mereka selaras dengan Dasar Privasi ini.
2.8. Anda bersetuju untuk memberikan hanya data peribadi yang tepat, lengkap dan terkini serta untuk memaklumkan kami tentang sebarang perubahan. Kami mungkin meminta dokumentasi dan melakukan semakan untuk mengesahkan data peribadi yang anda berikan, jika perlu.
2.9. Anda boleh memberi data peribadi kepada kami secara sukarela dan sesetengah kategori data peribadi adalah pilihan. Walau bagaimanapun, jika anda memilih untuk tidak memberikan data peribadi tertentu atau kemudiannya menarik balik persetujuan anda, kami mungkin tidak dapat menyediakan beberapa ciri Perkhidmatan atau akses kepada bahagian-bahagian tertentu Platform.
2.10. Jika anda mendaftar atau log masuk menggunakan media sosial atau akaun pihak ketiga yang lain, kami mungkin mengakses data peribadi tertentu daripada pembekal tersebut selaras dengan dasar-dasarnya, dan kami akan mengendalikan data tersebut selaras dengan Dasar Privasi ini.
3. Penggunaan dan Pendedahan Data Peribadi Anda
3.1. Kami menggunakan dan mendedahkan data peribadi untuk tujuan-tujuan yang diterangkan di bawah, selaras dengan undang-undang yang berkenaan dan, jika diperlukan, dengan persetujuan anda.

(a) Untuk menyediakan dan mengendalikan Platform dan Perkhidmatan
Mencipta dan mentadbir akaun anda
Membolehkan anda log masuk dan mengakses ciri-ciri yang berkaitan
Menjalankan dan menyelenggara platform e-dagang kami untuk komponen elektronik (semikonduktor)
(b) Analitik, Penyelidikan dan Pembangunan
Memahami cara pengguna berinteraksi dengan Platform dan Perkhidmatan kami
Menambah baik reka bentuk, kandungan, kefungsian dan prestasi Platform
Menjalankan analitik dan penyelidikan (cth. mengenai penggunaan, trend permintaan, minat produk)
Menguji dan menambah baik sistem, proses dan alatan kami
(c) Tujuan Undang-Undang dan Operasi
Mengesahkan identiti anda untuk pengesanan penipuan dan pengurusan risiko
Mengesan, menyiasat dan mencegah penipuan, penyalahgunaan, insiden keselamatan atau pelanggaran Terma Penggunaan kami atau dasar-dasar lain
Menjalankan semakan usaha wajar (due diligence) jika diperlukan (cth. sekatan, pematuhan kawalan eksport)
Mematuhi undang-undang, peraturan, perintah mahkamah dan permintaan yang sah daripada pihak berkuasa yang berkenaan
Menguruskan aduan, pertikaian, tuntutan atau penyiasatan
Menyokong pelaporan dalaman dan berkanun serta keperluan penyimpanan rekod
Memudahkan sebarang pemindahan perniagaan yang dicadangkan atau sebenar, penggabungan, pengambilalihan, pelaburan atau penstrukturan semula yang melibatkan DTDS
(d) Tujuan-Tujuan Lain dengan Persetujuan Anda
Sebarang tujuan lain yang kami maklumkan kepada anda pada masa pengumpulan dan yang anda persetujui.
Pemprosesan data peribadi anda oleh kami menurut Dasar Privasi ini mungkin atau mungkin tidak melibatkan pembuatan keputusan secara automatik tanpa sebarang penglibatan manusia melalui kaedah automatic sepenuhnya atau sebahagiannya.
Tujuan Tambahan
3.3. Sebagai tambahan, data peribadi yang kami kumpulkan daripada anda atau pihak ketiga juga mungkin digunakan untuk:
(a) Pengendalian dan Pemenuhan Pesanan
Memproses pesanan yang anda hantar melalui Platform tersebut
Menyediakan sebut harga, pengesahan pesanan, invois dan dokumentasi berkaitan
Menyelaraskan penghantaran dan penyerahan melalui rakan logistik atau pihak berkuasa berkaitan (cth. kastam)
Menguruskan pemulangan, penggantian, RMA dan sokongan selepas jualan
(b) Pemprosesan Pembayaran
Mengesahkan dan memproses transaksi pembayaran (cth. pindahan bank, pembayaran kad atau kaedah pembayaran lain yang ditawarkan)
Berkongsi maklumat berkaitan pembayaran dengan penyedia perkhidmatan pembayaran mengikut keperluan
(c) Sokongan Pelanggan
Menjawab pertanyaan, permintaan sokongan dan maklum balas anda
Menyediakan maklumat teknikal atau produk mengenai komponen elektronik dan penyelesaian berkaitan
(d) Pemasaran dan Komunikasi
Menyediakan kepada anda maklumat yang kami percaya mungkin berkaitan atau berguna, seperti:
pelancaran produk baharu atau alternatif kepada bahagian yang dihentikan
kemas kini teknikal, lembaran data (datasheets), nota aplikasi dan berita industri
Menghantar kepada anda komunikasi pemasaran atau promosi berkenaan produk dan perkhidmatan DTDS, tertakluk kepada keutamaan anda dan undang-undang yang berkenaan
Menjalankan tinjauan untuk lebih memahami keperluan anda dan menambah baik Perkhidmatan kami
Pendedahan Data Peribadi Anda
3.4. Kami mungkin berkongsi atau memindahkan data peribadi anda kepada pihak ketiga dan/atau syarikat gabungan kami untuk tujuan-tujuan yang diterangkan di atas. Ini mungkin termasuk, tetapi tidak terhad kepada:
Entiti kumpulan DTDS dan syarikat gabungan
Penyedia perkhidmatan pembayaran dan institusi kewangan
Logistik, pergudangan dan broker kastam
Penyedia perkhidmatan IT dan awan (cloud), syarikat pengehosan, penyedia analitik dan vendor teknikal lain
Penasihat profesional seperti peguam, juruaudit dan perunding
Pihak berkuasa yang berwibawa, mahkamah atau badan kawal selia, jika dikehendaki di bawah undang-undang
Pihak ketiga yang terlibat dalam penggabungan, pengambilalihan, pembiayaan, penjualan aset atau transaksi serupa yang berpotensi atau sebenar dengan kami
3.5. Apabila mendedahkan data peribadi anda kepada pihak-pihak tersebut, kami akan mengambil langkah-langkah yang munasabah untuk memastikan bahawa mereka melindungi data peribadi anda daripada akses, pengumpulan, penggunaan, pendedahan yang tidak dibenarkan atau risiko serupa yang lain, dan bahawa mereka hanya menyimpannya selagi diperlukan untuk tujuan-tujuan yang berkaitan.
Pemindahan Data Antarabangsa
3.6. Kami mungkin memindahkan data peribadi anda ke negara atau wilayah di luar bidang kuasa anda (termasuk Malaysia dan negara-negara lain di mana syarikat gabungan, pusat data, penyedia perkhidmatan atau rakan kongsi kami berada), untuk tujuan-tujuan yang dinyatakan dalam Dasar Privasi ini. Apabila kami berbuat demikian, kami akan memastikan bahawa perlindungan yang sewajarnya dilaksanakan sebagaimana yang dikehendaki oleh undang-undang perlindungan data yang berkenaan termasuk PDPA.
4. Penarikan Balik Persetujuan
4.1. Anda boleh menarik balik persetujuan anda terhadap penggunaan, pendedahan, penyimpanan dan/atau pemprosesan berterusan data peribadi anda oleh kami pada bila-bila masa, tertakluk kepada sekatan undang-undang atau kontraktual dan notis yang munasabah. Anda boleh berbuat demikian dengan menghubungi kami menggunakan butiran yang dinyatakan dalam Seksyen 11 di bawah.
4.2. Sila ambil perhatian bahawa jika anda menarik balik persetujuan anda terhadap penggunaan tertentu data peribadi anda, kami mungkin tidak lagi dapat menyediakan sebahagian atau semua Perkhidmatan kepada anda. Dalam kes sedemikian, kami tidak akan bertanggungjawab atas sebarang kerugian yang timbul daripada ketidakupayaan kami untuk terus menyediakan Perkhidmatan yang berkaitan.
Komunikasi Pemasaran
4.3. Anda boleh membatalkan langganan daripada e-mel pemasaran pada bila-bila masa dengan menggunakan pautan nyahlanggan dalam e-mel tersebut atau dengan mengemas kini keutamaan komunikasi anda (jika tersedia).
5. Pengemaskinian Data Peribadi Anda
5.1. Adalah penting bahawa data peribadi yang kami pegang tentang anda adalah tepat dan terkini. Anda bertanggungjawab untuk memaklumkan kami tentang perubahan pada data peribadi anda atau apabila anda percaya data peribadi yang kami pegang adalah tidak tepat atau tidak lengkap.
5.2. Anda biasanya boleh mengemas kini data peribadi anda dengan log masuk ke akaun anda di Platform dan mengedit profil anda.
5.3. Jika sesuai, kami mungkin berkongsi data peribadi anda yang telah dikemas kini dengan pihak ketiga dan syarikat gabungan yang telah kami kongsikan data anda, jika ia masih diperlukan untuk tujuan-tujuan yang diterangkan dalam Dasar Privasi ini.
6. Akses, Pembetulan dan Mengehadkan Pemprosesan Data Peribadi Anda
6.1. Tertakluk kepada undang-undang yang berkenaan, anda boleh meminta akses kepada data peribadi yang kami pegang tentang anda dan/atau meminta pembetulan sebarang data peribadi yang tidak tepat, tidak lengkap, mengelirukan atau tidak terkini, dan/atau meminta pengehadan pemprosesan data peribadi anda oleh kami. Anda boleh berbuat demikian melalui tetapan akaun anda (jika tersedia) atau dengan menghubungi kami seperti yang dinyatakan dalam Seksyen 11.
6.2. Untuk memproses permintaan anda, kami mungkin perlu mendapatkan maklumat tambahan daripada anda. Jika dibenarkan oleh undang-undang, kami mungkin menolak permintaan yang tidak berasas, berlebihan atau sebaliknya tidak perlu dipenuhi di bawah undang-undang yang berkenaan.
6.3. Jika dibenarkan oleh undang-undang perlindungan data yang berkenaan, kami berhak mengenakan fi pentadbiran yang munasabah untuk mengendalikan permintaan akses. Jika kami bercadang untuk berbuat demikian, kami akan memaklumkan anda tentang fi tersebut sebelum memproses permintaan anda.
7. Keselamatan Data Peribadi Anda
7.1. Kami mengambil langkah-langkah pentadbiran, teknikal dan fizikal yang munasabah untuk melindungi data peribadi anda daripada akses, pengumpulan, penggunaan, pendedahan, penyalinan, pengubahsuaian, kehilangan, penyalahgunaan yang tidak dibenarkan atau risiko serupa. Langkah-langkah ini mungkin termasuk:
Menyekat akses kepada data peribadi atas dasar perlu-tahu
Melaksanakan kawalan keselamatan rangkaian dan aplikasi (cth. tembok api (firewall), sistem pengesanan pencerobohan)
Menyulitkan (encrypt) data semasa penghantaran jika sesuai (cth. menggunakan TLS/SSL untuk data pembayaran)
Pemantauan dan pengujian sistem kami secara berkala untuk mengesan kelemahan
7.2. Walau bagaimanapun, tiada kaedah penghantaran melalui internet atau kaedah penyimpanan elektronik adalah selamat sepenuhnya. Walaupun kami berusaha melindungi data peribadi anda, kami tidak dapat menjamin keselamatan mutlak. Anda bertanggungjawab untuk merahsiakan kelayakan akaun anda dan mengambil langkah-langkah yang sewajarnya untuk melindungi peranti dan rangkaian anda.
8. Penyimpanan Data Peribadi
8.1. Kami menyimpan data peribadi selagi diperlukan untuk memenuhi tujuan-tujuan ia dikumpulkan, untuk memenuhi keperluan perniagaan kami, atau sebagaimana yang dikehendaki oleh undang-undang.
8.2. Apabila data peribadi tidak lagi diperlukan untuk tujuan-tujuan ini, kami akan mengambil langkah-langkah untuk memadamkan, menganonimkan atau sebaliknya melupuskannya secara selamat.
9. Kanak-Kanak Bawah Umur
9.1. Platform dan Perkhidmatan kami ditujukan terutamanya untuk pengguna perniagaan (cth. syarikat dan profesional yang membeli komponen elektronik) dan tidak ditujukan untuk individu di bawah umur 18 tahun. Kami tidak mengumpul data peribadi daripada kanak-kanak bawah umur (seperti yang ditakrifkan di bawah undang-undang yang berkenaan) secara sengaja, dan kami juga tidak berniat untuk menyediakan Perkhidmatan secara langsung kepada kanak-kanak bawah umur. Sekiranya kami sedar bahawa kami telah mengumpul atau memproses data peribadi daripada seseorang kanak bawah umur, kami akan mengambil tindakan untuk memadamkan data tersebut dengan segera.
10. Laman Pihak Ketiga
10.1. Platform mungkin mengandungi pautan ke laman web yang dikendalikan oleh pihak ketiga, seperti penyedia perkhidmatan pembayaran, rakan logistik atau pengilang. Kami tidak bertanggungjawab terhadap amalan privasi laman web pihak ketiga tersebut. Anda digalakkan untuk menyemak dasar privasi laman web tersebut untuk memahami cara mereka mengendalikan data peribadi anda.
10.2. Walaupun pihak ketiga tersebut mempunyai gabungan dengan kami, kami tidak mengawal laman web pihak ketiga tersebut dan tidak bertanggungjawab terhadap amalan privasi dan pengumpulan data mereka. Akses dan penggunaan anda terhadap laman-laman ini adalah atas risiko anda sendiri.
